1. Parties and Acceptance

These Terms of Service ("Terms") govern your access to and use of AICRRQ.com (the "Site"), including the AI-CRRQ™ Survival Index™ Calculator, the Live Threat Intelligence Map, all published framework content, and any paid services offered through this Site.

The Site is operated by Alim Abdul, an individual doing business as AICRRQ — Cyber Risk & Resilience Practice, located in New York, USA ("AICRRQ," "we," "us," or "our").

By accessing the Site, using any tool or calculator, downloading any content, or submitting any form, you ("User" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, your sole remedy is to cease using the Site.

2. Description of Services

AICRRQ provides the following through this Site:

• Free Informational Tools: The AI-CRRQ™ Survival Index™ Calculator, the Live Threat Intelligence Map visualization, framework documentation, methodology content, and whitepapers — all provided at no charge for informational and educational purposes.
• Paid Advisory Services: Professional engagements including cyber survivability assessments, tabletop exercises, board briefings, and advisory retainers — delivered by Alim Abdul / AICRRQ under separate service agreements.
• Newsletter and Updates: Optional email subscription providing framework updates and cybersecurity insights.

3. Free Tools — Informational Use Only

Specifically:

• Scores generated by the Survival Index™ Calculator are directional and self-reported — they are based entirely on inputs you provide and reflect your own self-assessment.
• Calculator results should not be relied upon as the sole basis for security investment decisions, regulatory compliance determinations, cyber insurance applications, legal positions, or board representations.
• Calculator inputs and scores are processed entirely within your browser. No data is transmitted to AICRRQ servers or stored in any way.
• No calculator output constitutes a guarantee, prediction, warranty, or professional opinion regarding your organization's actual ability to withstand or survive a cyberattack.
• For a certified organizational assessment, you should engage a qualified cybersecurity professional. AICRRQ offers professional assessment services — see Section 5.

4. Live Threat Intelligence Map — Simulation Disclaimer

Specifically:

• Attack arcs, event sequences, city pairings, and timing displayed on the map are algorithmically generated simulations inspired by global threat patterns — they do not represent verified, real-time network incidents.
• Aggregate statistics (active phishing counts, threats tracked) are sourced from independent third-party community feeds (PhishDestroy, URLhaus/abuse.ch, Feodo Tracker) and are subject to those sources' own accuracy limitations. AICRRQ does not verify, endorse, or guarantee the accuracy of these figures.
• The map must not be relied upon for operational security decisions, incident response, threat intelligence, regulatory reporting, or any purpose requiring verified threat data.
• The Survival Index™ methodology is entirely independent of the threat map visualization and is not derived from map data.

5. Paid Advisory Services

Paid engagements — including AI-CRRQ™ Survivability Assessments, Tabletop Exercises, Board Briefings, and Advisory Retainers — are governed by separate written service agreements entered into between AICRRQ and the client organization.

In the absence of a signed service agreement, no engagement, assessment, or advisory relationship exists between AICRRQ and any user, regardless of any communication exchanged through the Site's contact or booking forms.

AICRRQ advisory services represent professional advisory opinions — they do not constitute legal advice, certified regulatory compliance assessments, or representations that any specific security outcome will be achieved.

Fees and Payment

Fees for paid engagements are set forth in individual service agreements. All fees are in U.S. dollars. Payment terms, refund policies, and cancellation terms are specified in the applicable service agreement.

6. Intellectual Property

All content, methodology, branding, and tools on this Site are the intellectual property of Alim Abdul / AICRRQ:

• AI-CRRQ™ is a trademark of Alim Abdul. Federal trademark application pending — USPTO Serial No. 99730792, filed March 28, 2026.
• Survival Index™ is a proprietary mark of Alim Abdul / AICRRQ.
• The AI-CRRQ™ framework, three-vector model (TEI · ORCI · RVI), Survival Index™ formula, tier classifications, scoring methodology, all written content, diagrams, and visual elements are protected by copyright and proprietary rights owned by Alim Abdul.
• The site's source code, design, and all underlying software are proprietary and may not be copied, reproduced, or reverse-engineered.

Permitted Use of Framework Content

You may reference the AI-CRRQ™ framework in academic, research, or non-commercial contexts with proper attribution:

7. Permitted and Prohibited Use

Permitted Use

You may use this Site and its free tools to:

• Access and use the Survival Index™ Calculator for personal or organizational self-assessment purposes.
• View, read, and download published framework documentation and whitepapers for informational purposes.
• Contact AICRRQ to inquire about professional services.

Prohibited Use

You may not:

• Represent any output of the Survival Index™ Calculator as a certified security audit, compliance certification, or professional security assessment to any third party, regulator, insurer, or investor without written permission from AICRRQ.
• Reproduce, republish, sell, license, or commercially distribute any framework content, methodology, or tools without written authorization.
• Use the Site in any manner that violates applicable law, including HIPAA, HITECH, NYDFS Part 500, SEC cybersecurity disclosure rules, or any other applicable regulation.
• Attempt to reverse-engineer, scrape, or extract source code, algorithms, or methodology from the Site.
• Use the Site to transmit malware, spam, or any harmful content.
• Misrepresent any affiliation with, endorsement by, or certification from AICRRQ or Alim Abdul.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS SITE, ALL TOOLS, CALCULATORS, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

AICRRQ EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS;
• ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY CALCULATOR OUTPUT, THREAT MAP DATA, OR FRAMEWORK CONTENT;
• ANY WARRANTY THAT CALCULATOR OUTPUTS ACCURATELY PREDICT, REFLECT, OR GUARANTEE ANY ACTUAL SECURITY OUTCOME FOR YOUR ORGANIZATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE STATE OF NEW YORK AND APPLICABLE FEDERAL LAW, IN NO EVENT SHALL ALIM ABDUL OR AICRRQ BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS;
• DAMAGES ARISING FROM RELIANCE ON CALCULATOR OUTPUTS, THREAT MAP DATA, OR ANY FRAMEWORK CONTENT;
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
• DAMAGES ARISING FROM ANY CYBERATTACK, SECURITY INCIDENT, OR OPERATIONAL FAILURE EXPERIENCED BY YOUR ORGANIZATION.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF AICRRQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF ANY LIMITATION OF LIABILITY IS FOUND UNENFORCEABLE, AICRRQ'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AICRRQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

10. Indemnification

You agree to defend, indemnify, and hold harmless Alim Abdul, AICRRQ, and their respective agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Site or any tool in violation of these Terms;
• Your misrepresentation of any calculator output as a certified assessment or professional opinion;
• Your violation of any applicable law or regulation in connection with your use of the Site;
• Any claim by a third party arising from your reliance on Site content or calculator results.

11. Privacy

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key privacy points specific to the free tools:

• The Survival Index™ Calculator operates entirely in your browser. No calculator inputs, slider values, or scores are transmitted to AICRRQ servers.
• Contact forms and assessment requests collect only the information you voluntarily provide.
• We do not sell or share your personal information with third parties for marketing purposes.

12. Third-Party Links and Services

This Site references or links to third-party services including PhishDestroy, URLhaus/abuse.ch, Feodo Tracker, Calendly, and Google Fonts. These services are governed by their own terms and privacy policies. AICRRQ is not responsible for the content, accuracy, availability, or privacy practices of any third-party service.

Reference to any third-party product, framework, or organization (including NIST, ISO, FAIR, and others) is for comparative and informational purposes only and does not imply affiliation, endorsement, or partnership.

13. Healthcare and Financial Services Users

The AI-CRRQ™ Survival Index™ Calculator and framework are not designed or certified for use as a compliance tool under HIPAA, HITECH, NYDFS Part 500, SEC cybersecurity disclosure rules, DORA, NIS2, PCI-DSS, FFIEC, or any other regulatory framework.

Specifically:

• Calculator outputs do not constitute HIPAA risk assessments or satisfy any regulatory requirement for documented security risk analysis.
• Calculator outputs do not constitute evidence of reasonable security measures for purposes of any regulatory examination or enforcement action.
• Calculator outputs should not be submitted to regulators, insurers, or auditors as evidence of compliance without independent professional review and written authorization from AICRRQ.
• Organizations subject to SEC cyber disclosure rules should obtain independent legal and security counsel before relying on any framework output in connection with any required disclosure.

14. No Investment or Securities Advice

Nothing on this Site constitutes an offer to sell or a solicitation to purchase any security, investment, or financial instrument. These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Nassau County or Suffolk County, New York. You consent to the personal jurisdiction of such courts.

Before initiating any formal dispute, you agree to first contact AICRRQ at info@aicrrq.com to attempt good-faith resolution.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
